Terms and Conditions

The following Terms and Conditions form the basis of the contract between you and us. The acceptance of which is agreed upon the moment you sign our Branding, Hosting Agreement, Website Design Agreement, Website Development Agreement, SEO Agreement, or Support Agreement.

These Terms and Conditions are brief, easy to understand, and straightforward. Please contact us if you have any questions.

Definitions

  • Your name (‘The Client’)
  • ‘We’ (XRYTE BYTE TECHNOLOGIES)
  • Normally, a project consists of several components
  • Branding, Consulting, graphic design, website design, website development, SEO, and/or hosting are connected parts.

Agreement Between Parties

The Client Agrees To:

  • Provide the Company with all requested information, including text, images, and other materials, within a reasonable timeframe.
  • Provide feedback, sign off approval, and review the Company’s work.
  • Keep all deadlines agreed upon.
  • Pay according to the payment schedule outlined on our prices page or as agreed upon separately for bespoke work.
  • Inform in advance about any confidential information, clearly marking written documents as confidential.
  • Give one month’s notice in writing or by email to cancel a contract.

The Company Agrees To:

  • Maintain a professional and timely service delivery system.
  • Stay on top of any deadlines we have agreed upon.
  • Make a reasonable number of revisions to the design, layout, colours, etc., until you are satisfied (max two major revisions). Additional revisions will be charged separately.
  • Complete website revisions or updates within 48 hours whenever possible.
  • Conduct regular training and research to maintain current skills.
  • Contact you before the end of the first 12-month period to discuss maintenance options.

Website Design

  • Our websites are designed to work across all major browsers and platforms. However, we cannot guarantee long-term compatibility due to third-party updates.
  • We cannot guarantee compatibility with old or redundant browser software.

E-commerce, Database, and Application Development

  • XRYTE BYTE TECHNOLOGIES is not responsible for losses caused by software created for clients. Clients must ensure software functions properly before use.
  • For applications on external servers, the client is responsible for obtaining necessary support and software.
  • Clients must fully test any application before it goes live. We will endeavor to correct bugs found after launch but are not obligated to do so indefinitely.

Search Engine Optimization (SEO)

  • We provide recommendations after gap analysis. All input must be included for indexing.
  • Development effort exceeding 40 Man Hours will be billed on a time-and-material basis.
  • We require FTP access to the current site.
  • SEO focuses on organic growth and takes 4-6 weeks to implement.
  • We do not guarantee immediate results or top positions within six months.
  • Service taxes are extra. Termination requires 60 days' notice.

Contract Lengths and Payments

  • Payment schedules are outlined on our prices page or discussed for bespoke work.
  • Cancellation during the first 12 months is a breach of contract, requiring immediate payment of the balance plus an admin fee.
  • Clients are responsible for updating standing orders. Overpayments due to client error are not reimbursed.
  • Contracts are usually 12 months. Cancellation of support/hosting requires 30 days' notice.

Images and Copyright

  • Images should be in digital format (min 1024x768). Scanning/retouching incurs extra costs.
  • Clients must have legal permission for all provided materials and hold the Company harmless against claims.
  • Copyright is assigned to the client after the initial 12-month period.
  • We reserve the right to display the project in our portfolio and place a small link at the bottom of the website.

Hosting and Liability

All websites are hosted on high-speed managed dedicated servers with 99.95% availability.

The Company is not responsible for missed deadlines if the Client fails to provide materials or approval on time.

Confidentiality

We strictly adhere to all privacy, data transfer, and confidentiality regulations.

General Terms

  • Websites will not launch without payment agreement.
  • Additional features are invoiced separately.
  • We do not offer technical support for third-party hosting.
  • The Company is not liable for third-party damages, lost profits, or incidental damages.
  • This agreement is severable if any provision is unlawful.

Payment Terms

Development Costs: 50% upfront, 50% upon completion.

Mode of Payment: Direct deposit, online via credit/debit card, or cash.

Online Payments: Securely processed via Payment Gateway. We do not store credit card details.

Cancellation & Refund: No refund if service is cancelled. 50% refund if work has not started.

Timeline for Delivery

Delivery of services usually takes 3-7 days or as agreed.
